Hello,

you do not know me, but I just wanted to say thank you. My husband and I was looking to purchase a new home. We would have been 1st time home buyers. Our only income is my husbands so we were not trying to get into a lending nightmare. I was flipping through the channels and watched you on your televised meeting from 7-19-2003, on predatory lending, the foreclosures. I learned so much from you. I want to praise the work you are doing and you are reaching people.

We were going to do a 2/1 buy down, zero down payment, Nehemiah and the works. We knew going into it was going to up the loan, but you said if that person sells the home tomorrow they are upside down. We looked at homes in Noblesville, Carmel, Fishers, Oaklandon all the places you named. I just wanted to take the time out to thank you for caring enough to help us and others out there that are just as lost. We can now realize that we are not quite ready yet to purchase a home and to save more money, and do a lot more investigating. I am so afraid that with the tax hike and builders brother lending, we would have made a terrible and costly mistake, and may have even ran into foreclosure problems without even realizing it. So again I thank you so much. Take care and continue doing a wonderful job the public is watching and listening!

I just saw the taping of the MCANA meeting on July 19, 2003 on WCTY. I normally just pass by that station after a second of hearing what is on, but when I heard just a little of what you were talking about I had to stop and listen.

I recently turned in a Contract Termination letter to one of our Indianapolis area builders due, to what I feel, was misrepresentation and fraudulent actions by a lender in creating my pre-commitment letter to this builder. I am not an expert in this field, but feel that I know some of the issues to protect myself (2-1- Buy-down; Tax assessment; inflated appraisals), but when this mortgage company placed a stipulation of re-financing my current home if it did not sell in time, and specifically stated verbally at least 4 times, that they would do the refinancing, little did I know that basically, my home could not be refinanced according to their rules (which match many other lenders). The Lender had stipulated that I was pre-approved but I had to refinance my home. I did not know, nor was told that I needed to have 20% equity in my home (only being here 4 years) to refinance as an 'investment property' (Also needed to lease house out, even though I could qualify for both mortgage payments). I did not have during application (or do I now) the cash funds to make up the 20% to close on a conventional refinance loan. I also did not know that even after being told that this lender WOULD refinance our home, that according to their rules, there was no way.

I have sent all my documentation to the lender and builder. I am now waiting to her their response to it.

I would like to share my specific information with you so that, if you deem pertinent, you can share this will others. I have requested that if the builder feels that they need to seek damages, that they go to the lender. I will not submit to the builder on this and am ready to take whatever action that I can. I feel violated and hurtful that my family spent our time and hearts on a home that we would not have 'bought' had we known the pertinent information that they were keeping from us.
